Terms & Conditions for our Tours

By booking or participating in a bespoke tour and any related products or services (a “Tour”) with GRRRLTRAVELER LLC, a company (“GRRRLTRAVELER” or the “Travel Host”), you (“you” “Customer”) agree to these Terms & Conditions (the “Terms”).\

By booking a Tour you acknowledge that you have read, understand and agree to be bound by these Terms. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party.

1. Booking Contract

Your booking is confirmed and a contract exists when your payment for a tour is paid in full. Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passport.

You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to GRRRLTRAVELER and/or our inbound operator partner.

Any changes to your name on any booking within 10 days of departure are subject to GRRRLTRAVELER’s approval. Any extra costs incurred for making the change will be charged to you along with an administrative fee. No changes are permitted to any booking within 10 days of departure of the first product or service on the applicable booking.

2. Required Booking Details

As a condition of booking, you must provide the information requested by GRRRLTRAVELER along with final payment. If you fail to supply information required by GRRRLTRAVELER for air tickets, permits, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion.

Customer Names provided for booking reservations must match Customer’s passport. Date of birth and complete passport details are required. Any minor name corrections advised after airline tickets have been issued will incur fees. Not all name corrections will be permitted by airlines and may require the purchase of a new ticket. You voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation.

In the event that you fail to supply information required by GRRRLTRAVELER, GRRRLTRAVELER reserves the right to treat your booking (or the relevant component of your booking) as canceled and levy any cancellation fees deemed reasonable by GRRRLTRAVELER, in its sole discretion. The information required by GRRRLTRAVELER will vary by Tour and will be communicated to you or to GRRRLTRAVELER’s authorized agent during the booking process.

You are responsible for ensuring that the information provided to GRRRLTRAVELER is accurate and up-to-date. GRRRLTRAVELER will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.

3. Booking on Behalf of Others

Should you book on the behalf of others, you acknowledge that you are regarded as the designated contact person for each participant listed on the booking and you are in charge of paying all fees associated with your tour booking, keeping your group informed, and alerting GRRRLTRAVELER and/or our local operator partner of any necessary adjustments or cancellations. Our age requirement minimum for tours is 18 years old.

You represent and warrant that you have obtained all necessary consents by making a reservation on behalf of another person or persons. GRRRLTRAVELER is not held liable for any errors or omissions in the information provided to complete a booking; it is your responsibility to ensure that any information you supply on behalf of another participant is complete and accurate.

4. Tour Destinations

Travel always involves greater risk than daily life and it is also vulnerable to crime.  GRRRLTRAVELER urges Customer to be informed daily as to current news and to review travel and crime warnings, announcements, and advisories issued by the United States Government (or the government of your resident country) prior to booking travel to international destinations. For U.S. citizens, information on conditions and the level of risk associated with travel to destinations can be found at https://www.travel.state.gov and https://www.cdc.gov.

Additionally, consult with government websites to ensure that you are following all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, GRRRLTRAVELER will not be liable for damages or losses that result from travel to such destinations.

5. Travel Documents- Passports, Visas

Travel documents: It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes any visas, permits, certifications (such as immunization, vaccine or medical certificates), and insurance policies that may be required by the relevant government agencies.

You must have a passport that is still valid, and your final date of travel with GRRRLTRAVELER as indicated on your itinerary must be at least six months away. You assume full responsibility for obtaining all essential documentation, such as visas and permits, prior to the start of the Tour..  For up-to-date requirements US citizens should visit www.travel.state.gov.

Additionally, you are entirely responsible for paying any fees related to incomplete or inaccurate documents

You agree to accept full responsibility for any loss or expense incurred by GRRRLTRAVELER as a direct result of your inability to secure or possess valid travel documentation. You acknowledge and agree that GRRRLTRAVELER disclaims all liability for any errors or omissions in this information, does not provide advice on travel documents, and disclaims any representations or warranties regarding the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment.

6. Mandatory Travel Insurance

Travel insurance is mandatory on all GRRRLTRAVELER tours. You will not be able to join our tour without proof of it. You may use your credit card insurance if it covers the tour destination. If you do not have travel insurance, Christine uses World Nomads for adventure travel. You can also find good insurance policy options with Travel Master insurance finder. You must have personal accident, death, medical expense, and emergency repatriation coverage as part of your travel insurance. Additionally, we strongly advise that it includes coverage for COVID quarantine, cancellation, curtailment, personal liability, and loss of luggage and other belongings.

You must provide your travel insurance policy number and the insurance company’s 24-hour emergency contact number 7 days before the trip. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank’s name and credit card details. You will not be able to join the trip without these details

GRRRLTRAVELER is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. GRRRLTRAVELER cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent.

7. Required Medical Information

You may be required to complete the medical information form enclosed in the Liability Waiver form (the “Medical Form”), available on the Tour Operator’s website at http://www.grrrltraveler.com/medical-form

If you have any pre-existing medical conditions that could affect your ability to travel, participate in a Tour, travel to remote areas without access to medical facilities, or should it negatively affect the experience of others on your Tour, then you must have a licensed and practicing physician sign this form.

You must fill out the medical form truthfully and provide complete, accurate, and pertinent medical information.  Pregnancy is a condition that must be told to GRRRLTRAVELER at the time of booking because it is seen as a medical issue. Women who are above 24 weeks pregnant may not be allowed to go. GRRRLTRAVELER could decide not to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged. GRRRLTRAVELER reserves the right to refuse you permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense.

GRRRLTRAVELER retains the right to cancel your reservation and all associated cancellation fees will apply if you fail to submit the appropriate medical information requested by GRRRLTRAVELER before the noted deadline.

It is your responsibility to decide if a Tour is appropriate for you. To ensure that you are healthy enough to travel and take part in any planned activities, you should speak with your doctor. It is your obligation to evaluate the dangers and requirements of each component of the Tour in light of your particular situation, restrictions, level of fitness, and medical needs.

8. Immunizations

Traveling with GRRRLTRAVELER may entail stopping in remote areas, where access to medical care may be limited and medical facilities may not be up to par with those in your home country. The quality of the medical facilities in the nations you could go to on your tour varies, and GRRRLTRAVELER makes no guarantees or statements regarding their availability or caliber in those areas.

It is recommended to consult your doctor for guidance on immunizations and travel shots. They may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Immunization/ innoculation information can be found on the Center for Disease Control website at https://www.cdc.gov/.

9. Special Requirements

At the time of booking, GRRRLTRAVELER must be informed of any particular needs. Given the nature of the countries visited and the availability of options outside of a scheduled itinerary, GRRRLTRAVELER will make reasonable attempts to fulfill particular needs or requests, but this is not always practicable. If your movement is restricted in any manner, you might not be able to participate in some activities. GRRRLTRAVELER must be informed of any food allergies and dietary requirements at the time of booking, however GRRRLTRAVELER cannot ensure that dietary demands or limitations will be met. The contract between you and GRRRLTRAVELER does not include any specific requests or requirements, and GRRRLTRAVELER is not responsible for any such requests or needs.

10. Deposits

A non-refundable deposit in the amount shown on the tour page, is required at the time of booking. See the tour sales page for specifications as tour requirements may vary. At the time of booking, full payment is required 60 days before departure.

11. Final Payment 

The confirmation sent by GRRRLTRAVELER or the partnering inbound operator will contain details of final payment required for any booking. If full payment is not received by 60 days before tour date, GRRRLTRAVELER may, at its sole discretion, treat the booking as cancelled, offer the spot to waitlisted guests and retain the deposit paid on booking as a cancellation fee, according to Terms. If a booking is made less than 60 days before the departure date of the first product included in the applicable booking, then the full amount must be paid at the time of booking. If, for any product or service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.

GRRRLTRAVELER is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to GRRRLTRAVELER.

12. Cancellation Policy

You may cancel your booking by notifying GRRRLTRAVELER . Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by the inbound local Tour Operator and are expressed as a percentage of the total price paid for the cancelled Tour, product or service (excluding any insurance products)

We have two policies so please read closely. Our refund policy for cancellations is as follows:

In the special circumstance that on the trip payment final deadline and/or when tour greenlight announcements or deposits are made to the local operator to secure our trip, and you are the customer makes up part of the minimum pax that was needed to greenlight the tour :

We cannot offer refunds of payment as your spot has counted as part of the operational costs of green lighting the group trip for everyone. Once the tour operator has been notified of a greenlight, payments are sent to reserve our bookings and letters of invitation are being processed.

However, we may allow you to transfer your spot to another traveler’s name to go in your place. A $200 admin fee apples for any name changes  (and in the case the fee for this switch is greater than $200, you must pay the additional costs for the transfer).

If we have secured than our required minimum pax of guests for the trip to operate, the following cancellation fees apply.

The number of days before tour starts vs refunded amount:

119 to 76 days   100% refund (deposit is not included in this refund)
75 to 61 days       50% refund (deposit is not included in this refund)
60 to 1 days           0% refund

As a trip host of bespoke tours, GRRRLTRAVELER partners with local/destination tour operators who require payment deposits to secure your tour spot with hotels, transportation, flights, etc.. For the security of the group experience and to keep our tour price from rising we require cancellations to be as such. I thank you for your understanding of my strict policies.

13. Cancellation of the Tour by the Tour Operator or GRRRLTRAVELER

If a Tour is cancelled by the local/destination tour operator or GRRRLTRAVELER before the date of departure for reasons other than Force Majeure and your fault or negligence does not cause the cancellation, you will have the choice of accepting from GRRRLTRAVELER:

(a) have your payment be applied to another available tour/dates , 

(b) a substitute Tour of lesser value if no Tour of equivalent or superior value is reasonably available; or

(c) a refund of all monies paid for the canceled Tour (minus a portion of your deposit). 

GRRRLTRAVELER reserves the right, in its sole discretion, to issue a full refund in place of the options above. GRRRLTRAVELER and the local inbound tour operator are not responsible for any incidental costs or consequential losses that you incur as a result of the canceled booking, including visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment. When a substantial component of a tour cannot be provided after departure, the local inbound tour operator will, whenever possible, make adequate substitute arrangements. This will depend on how the inbound Tour Operator interprets the situation.  GRRRLTRAVELER will not offer refunds on goods or services offered to you and that you reject of your own accord and free will.

14. If You are Asked to Leave a Tour

Any sexual/harassment, non-compliance, lewd and inappropriate actions to another guest or staff or extremely negative or harmful attitude to make any guest or staff feel uncomfortable will not be tolerated on GRRRLTRAVELER tours and may result in removal from the tour. 

If you are asked to leave a tour for bad behavior, violence, or any other disruptive action, you will not be refunded and no credits will be provided. GRRRLTRAVELER is not responsible for any of your travel expenses that may arise from the moment you are asked to leave our tour.

15. Flexibility, Unused Services & Changes by the Supplier

You acknowledge that the nature of adventure travel necessitates adaptability and that you will allow GRRRLTRAVELER to make reasonable changes to the products, services, or itineraries. Due to unforeseen situations or events beyond the control of GRRRLTRAVELER, the itinerary, schedules, accommodations, activities, facilities, and mode of transportation are all subject to change without prior notice (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties).

If between planning time and/or during actual travel, circumstances require changes, our suppliers, reserve the right to cancel or vary any itinerary and substitute components of any tour, including but not limited to hotels and accommodations of comparable quality, if air schedule or surface transportation charges, security matters, and/or other events make such alterations necessary.

No compensation, discounts, or refunds will be given for services missed or unused after departure due to circumstances beyond the control of GRRRLTRAVELER, including your expulsion from a Tour as a result of your carelessness or violation of these Terms. Normal cancellation penalties still apply to the tour that has been changed.

16. Changes made by us

GRRRLTRAVELER may modify your itinerary where reasonably required in its sole discretion. GRRRLTRAVELER may make a change or replace an activity or supplier due to a change in the condition, quantity or quality of the vendor/supplier, or due to unforeseen circumstances.

Once a Tour has departed, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at the discretion of GRRRLTRAVELER. If so, GRRRLTRAVELER will substitute the activity with something of equal or higher standard. GRRRLTRAVELER will notify you as soon as possible , provided that there is sufficient time to do so.

You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with GRRRLTRAVELER, whether or not such expenses arise from a change of itinerary, and GRRRLTRAVELER is not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during travel. GRRRLTRAVELER will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary.

17. Risk Acceptance

You acknowledge that adventures travel and the products and services offered by GRRRLTRAVELER may involve a significant amount of risk to your health and safety. You hereby assume responsibility for all such risks and release GRRRLTRAVELER from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by GRRRLTRAVELER. GRRRLTRAVELER requires that you confirm this responsibility by completing the participation waiver (Download the “Liability Waiver & Release Form” ) prior to departing on your tour.

You agree that the nature of adventure travel necessitates adaptability and that you will allow GRRRLTRAVELER to make reasonable changes to the Tour’s products, services, or itineraries. GRRRLTRAVELER has no control over unforeseen circumstances or events, thus the itinerary, schedules, lodging, activities, facilities, and mode of transportation are all subject to change without notice (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). For services missed or not used after departure owing to circumstances beyond the control of GRRRLTRAVELER, including your expulsion from a Tour due to negligence or a violation of these Terms, no reimbursements, discounts, or refunds will be given.

You acknowledge you have considered the potential risks, dangers, crime and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on Tour or, if in the opinion of GRRRLTRAVELER (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, GRRRLTRAVELER may terminate your travel arrangements on any product or service immediately at your expense and without any liability on GRRRLTRAVELER’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You are responsible for any costs (including repair, replacement and cleaning fees) incurred by GRRRLTRAVELER or GRRRLTRAVELER’s suppliers for property damage, destruction or theft caused by you while on a Tour. You agree to immediately report any pre-existing damage to a representative of GRRRLTRAVELER and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.

You agree to take all prudent measures in relation to your own safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither GRRRLTRAVELER nor its Third Party Suppliers (as defined herein) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.

You agree to bring any complaints to GRRRLTRAVELER as soon as possible in order to provide GRRRLTRAVELER with the opportunity to properly address such complaint. You agree to inform your tour leader, another representative of GRRRLTRAVELER or GRRRLTRAVELER’s customer service department directly. GRRRLTRAVELER assumes no liability for complaints that are not properly brought to the attention of GRRRLTRAVELER and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Tour must be received in writing by GRRRLTRAVELER within 30 days of the last day of travel of the booking in question.

18. We are not liable for Third Party Suppliers.

GRRRLTRAVELER is not a carrier, travel agent, hotelier, or Tour Operator nor does it own aircraft, hotels or coaches/transportation. GRRRLTRAVELER is is hosting the trip and engages into arrangements with local inbound tour operators who supply the activities, accommodations, transportation, guides, and other independent parties to offer you with some or all of the components of your booking (collectively, “Third Party Suppliers”). Third Party Suppliers may also use nearby operators and subcontractors. GRRRLTRAVELER, despite taking all reasonable precautions when selecting Third Party Suppliers, has no control over and does not supervise Third Party Suppliers, and as a result, GRRRLTRAVELER is not responsible for their actions or inactions.

Any services provided by Third Party Suppliers are subject to the terms and conditions set forth by these Third Party Suppliers, and their liability is restricted by the international conventions and agreements that govern the provision of their services, as well as their tariffs, conditions of carriage, tickets, and vouchers. These might restrict or exclude the third-party supplier’s liability. GRRRLTRAVELER does not guarantee that any Third Party Supplier complies with the laws of your country of residence or any other jurisdiction. You understand that Third Party Suppliers act in accordance with the applicable laws of the countries in which they operate.

GRRRLTRAVELER and its representatives is not responsible for, and will not assume liability for, any claims, losses, damages, costs, or expenses resulting from inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental, caused by any party other than GRRRLTRAVELER and its employees’ actions or inactions.

You, the Customer acknowledges and agrees that GRRRLTRAVELER and its representatives assume no responsibility to you and will not be held liable by you for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity by reason of:

(1) any wrongful or negligent acts or omissions on the part of the suppliers or service providers,

(2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee or representative of these suppliers or service providers,

(3) any defect in or failure of any vehicle, equipment or instrumentality owned, operated, or used by any of these suppliers or service providers, or

(4) any wrongful or negligent acts or omissions on the part of any other party not under the direct control of GRRRLTRAVELER.

The Third Party Suppliers and any independent contractors are not held responsible by GRRRLTRAVELER for any actions or inactions, whether negligent or not.

19. Indemnification

You agree to and shall indemnify and hold harmless GRRRLTRAVELER, and each of our officers, employees and representatives (collectively “GRRRLTRAVELER”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by GRRRLTRAVELER (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) Your breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by you while participating in the trip.

You further agree that if they violate this agreement and attempt to bring suit against any part of parties named herein, that they will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.

 

20. Complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip.

21. Optional Extras

“Optional Extras” refers to any activity, transportation, meal, product or service not expressly included in the Tour itinerary or price of the Tour and which does not form part of the Tour. You agree that any assistance given by GRRRLTRAVELER’s representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and GRRRLTRAVELER makes no warranties and expressly disclaims any liability whatsoever. You release GRRRLTRAVELER from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.

You agree that we are not in any way responsible for any assistance, suggestions, or advice given by your group leader or local representative in setting up optional activities (including those before or after a trip). You and the activity provider will enter into a contract for the supply of that activity.

You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.

22. Limit of Liability

GRRRLTRAVELER LLC and its parents, subsidiaries and their respective employees, affiliates, successors, representatives, and assigns shall not be held liable for

(A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and

(B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against GRRRLTRAVELER for any such loss, damage, injury, or death.

In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of GRRRLTRAVELER or of the Third Party Suppliers of any services which form part of the booking contract then GRRRLTRAVELER limits its liability, where applicable by all applicable international conventions..

Notwithstanding anything to the contrary elsewhere in these Terms, GRRRLTRAVELER will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature.

For claims not involving personal injury, death or illness or which are not subject to the Conventions referred to above, any liability GRRRLTRAVELER may incur for the negligent acts or omissions of its suppliers will be limited to a maximum of the price which you paid for the applicable Tour,.

23. Force Majeure

GRRRLTRAVELER will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for GRRRLTRAVELER failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather,technical or maintenance problems with transport, physical injury, quarantine,  medical or customs regulation, delay or cancellation, epidemic, pandemic,  significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and the ongoing effects of, Covid-19 or SARs-COV2, or any other cause whatsoever beyond the reasonable control of GRRRLTRAVELER, the Tour Operator or the Third Party Supplier of services, whether or not foreseeable, which would make it dangerous or not viable for a Tour to commence or continue, any and all of which, individually and collectively, constitute “Force Majeure”. In the case of Force Majeure, we will not be responsible for any refund, although if we do receive any refund from our suppliers, we may provide that to you within the guidelines of these Terms & Conditions. The deposit is always non-refundable.

24. Media Waiver & Permissions

By traveling with GRRRLTRAVELER, you consent to use of images taken of your being used for advertising and promotional purposes unless otherwise notified. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes in any format whatsoever, now known or hereafter developed, without any further obligation or payment due to you.]. You also agree that while on any Tour, other participants, GRRRLTRAVELER, or its representatives may take photographs or videos of you that may include or otherwise feature you.

25. Privacy Policy

GRRRLTRAVELER must collect your personal information to deliver the Tour and any products or services booked. GRRRLTRAVELER collects, uses and discloses only that information reasonably required to enable GRRRLTRAVELER and its Third Party Suppliers to provide the particular Tour, products and/or services that you have requested as described in GRRRLTRAVELER’s Privacy Policy, which can be accessed any time at http://www.grrrltraveler.com/privacy/ and is expressly incorporated into these Terms. By submitting any personal information to GRRRLTRAVELER, you indicate your acceptance of GRRRLTRAVELER’s Privacy Policy.

26. Severability

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

27. Contract Parties & Successors

These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors and assigns.

28. Governing Law,  Class Action Waiver, Damage Limitation

The Contract and these Terms are subject to the laws of Hawaii and you submit to the exclusive jurisdiction of the courts located in Hawaii for the resolution of any dispute under these Terms or concerning any Tour, product or service. You agree that you will only bring claims against

GRRRLTRAVELER in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. GRRRLTRAVELER shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages.

You understand and agree that no claims will be considered and that you will not bring suit against GRRRLTRAVELER unless you have first provided a typewritten notice of claim to GRRRLTRAVELER within 30 days after the tour or cancellation of the trip.

29. Amendments

GRRRLTRAVELER reserves the right to update or alter these Terms at any time, and will post the amended Terms on GRRRLTRAVELER’s website at grrrltraveler.com/terms-conditions/.

Any amendment will take effect 10 days after being posted to GRRRLTRAVELER’s website. An up-to-date copy of these Terms, as amended, may be accessed at any time on GRRRLTRAVELER’s website and will be sent to you upon written request to GRRRLTRAVELER.

You are deemed to have accepted any amendments to these Terms on the date that is 10 days after their posting on GRRRLTRAVELER’s website.

GRRRLTRAVELER recommends that you refer to the Terms prior to travel to familiarize themselves with the most up-to-date version available.
